Context of the case

TERRILLON AVOCATS was contacted by a natural person, the manager of several companies in Poland, who was the victim of a website entirely targeted at him and on which there was a lot of personal and defamatory information. His reputation was being damaged.

 

Our involvement

TERRILLON AVOCATS then sought to have the defamatory and personal information about our Client removed from the website. 

Before taking any steps to remove the said material, the first step was to have it witnessed by a bailiff in order to prove that the website and the content thereof existed before they were deleted. This approach allowed the Client to consider subsequently suing the site’s publisher and obtaining compensation for damages while avoiding waiting for a hearing to have the site deleted. 

The second step consisted in identifying the publisher of the site, who appeared to be anonymous, by contacting both the hosting company and the French Network Information Centre (Association Française pour le Nommage Internet en Coopération)

At the same time, TERRILLON AVOCATS informed the National Commission on Informatics and Liberty (Commission Nationale de l’Informatique et des Libertés) and took the necessary steps with Google to have the published content containing the Client’s personal data deleted.

These services, provided by TERRILLON AVOCATS, enabled the Client to obtain the deletion of the website and to recover his full credibility and reputation with his Clients, partners, prospects, and employees.
